Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you ("user" or "you") and FairFlow ("we," "us," or "our"), concerning your access to and use of the FairFlow mobile application and any related services (collectively, the "Service").

By accessing the Service, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Service and you must discontinue use immediately.

2. Description of Service

FairFlow is an AI-powered voice-to-text dictation application that utilizes advanced artificial intelligence models, including OpenAI's Whisper and GPT, to transcribe, summarize, and organize your voice notes.

Because the Service relies on AI models, output may sometimes be inaccurate or incomplete. You are responsible for reviewing the generated content and ensuring its accuracy before relying upon it.

3. User Accounts and Minute Balance

• Account Creation: You must create an account to use the Service. You are responsible for keeping your account credentials secure.
• Usage Balance: Access to transcription and summarization features is consumed from your account's minute balance. FairFlow offers one-time, consumable minute packs purchased through the App Store. These are not subscriptions and do not auto-renew.
• Purchases: Minute packs are consumable in-app purchases. Once purchased, minutes are added to your balance and are consumed as you use the transcription service. Purchases are final and non-refundable except as required by the App Store's terms or applicable law. Minutes do not expire. All purchases made through the App Store or our billing providers are subject to their respective terms and conditions. We are not responsible for any payment processing errors caused by third parties.

4. Privacy and Data Handling

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and processing of your audio recordings, text, and other data as described in the Privacy Policy.

Our Service utilizes external APIs (including OpenAI, Supabase, RevenueCat, PostHog, and Sentry) for core functionality, data storage, payment processing, analytics, and error tracking. We ensure that our partners comply with industry standards for data protection, and your data is explicitly opted out of being used for AI model training by OpenAI.

5. User Conduct and Restrictions

You agree not to use the Service to:

• Record or dictate content that is illegal, defamatory, harassing, or violates the rights of any third party.
• Reverse engineer, decompile, or attempt to extract the source code of the app.
• Interfere with or disrupt the integrity or performance of the Service or its related systems.

6. Intellectual Property

Your Content: You retain all rights and ownership to the audio you dictated and the resulting text generated by the Service.

Our IP: FairFlow retains all proprietary rights in the Service, including its design, codebase, branding, and features.

7. Disclaimer of Warranties

The Service is provided on an "as-is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, accuracy, or availability of the Service. We do not guarantee that the AI transcriptions will be entirely error-free.

8. Limitation of Liability

In no event shall FairFlow be liable to you or any third party for any indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the Service.

9. Modifications to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms in the application. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
